جمهور العلماء يقول أنه لا حق للزوج على زوجته

قد تسمعون أحياناً عن حوادث طلاق أو ضرب للزوجة من قبل الزوج بسبب أمور تافهة مثل (عدم طبخ الغداء) أو (تأخير الغداء) أو (حرق الغداء) وغيرها من تلك الأمور …

وعندما تسألهم عن سبب ذلك التصرف يكون القول: (لأنها أهملت في واجباتها الشرعية) !!!

لا تعليق على ذلك الرد …

ولكن … هل فكر أحدكم يوماً من الأيام عن الحكم في خدمة الزوجة لزوجها من الناحية الشرعية ؟؟؟ (وليس من الناحية العرفية) …

يكون السؤال على النحو التالي …

هل يجب على المرأة (شرعاً) الطبخ لزوجها ؟؟؟ أو تنظيف البيت أو الملابس ؟؟؟

أنقل لكم ما يلي … وستعرفون الإجابة بأنفسكم …

مذهب الجعفرية:

يذهب الفقهاء المعاصرون إلى أن الخدمة المنزلية ليس من واجبات الزوجة، بل هي من واجبات الزوج،أما ما هو متعارف عليه في مجتمعنا من قيام الزوجة بالخدمة المنزلية من طبخ وتنظيف وكنس .. وغير ذلك من مستلزمات خدمة المنزل فهو من المستحبات التي تثاب عليه الزوجة بالثواب الجزيل، لكن ذلك ليس من واجباتها الشرعية تجاه زوجها، يقول السيد السيستاني: ((لايستحق الزوج على الزوجة خدمة البيت وحوائجه التي لاتتعلق بالاستمتاع من الكنس أو الخياطة أو الطبخ أو تنظيف الملابس أو غير ذلك حتى سقي الماء وتمهيد الفراش وإن كان يستحب لها أن تقوم بذلك)) وقال السيد صادق الشيرازي: ((لايحق للزوج إجبار زوجته على القيام بالخدمة المنزلية)) وقال الشيخ محمد الفاضل اللنكراني : (( لايستحق الزوج على زوجته خدمة البيت وما شاكلها )) وبهذا المضمون قال كل من تعرض لهذه المسألة من الفقهاء المعاصرين .

وبالرغم من عدم وجوب الخدمة المنزلية على الزوجة إلا أن قيامها بذلك – فضلاً عما في ذلك من الأجر والثواب – يعمق المحبة والمودة بين الزوجين، كما يساعد على إنجاح الحياة الزوجية. ومن جهة أخرى فإن مايحدث أحياناً من تعامل متعسف يصل لحد الضرب أو الأذى النفسي والجسدي من قبل بعض الأزواج تجاه زوجاتهن نتيجة للتقصير في الخدمة أو عدم إتقان الطبخ – مثلاً – يعبر عن عدم التفقه في أحكام الله، إذ يتعامل الأزواج مع زوجاتهن وكأن الخدمة المنزلية من الواجبات الشرعية على الزوجة ، بينما المسألة ليست كذلك، إذ يجب على الزوج نفسه إخدام زوجته كما مَرَّ توضيحه بالتفصيل, بيد أن الخدمة المنزلية بل وكذلك الرضاع والحضانة ليس من واجبات الزوجة، بل يجوز لها المطالبة بأجرة مقابل الرضاعة والحضانة حتى لأطفالها.

مذهب الحنفية:

قال الإمام الكاساني في (البدائع): ( ولو جاء الزوج بطعام يحتاج إلى الطبخ والخبز فأبت المرأة الطبخ والخبز لا تجبر على ذلك، ويؤمر الزوج أن يأتي لها بطعام مهيأ.

ومن ذلك ما ورد في (الفتاوى الهندية في فقه الحنفية): ( وإن قالت لا أطبخ ولا أخبز لا تجبر على الطبخ والخبز، وعلى الزوج أن يأتيها بطعام مهيأ أو يأتيها بمن يكفيها عمل الطبخ والخبز).

مذهب المالكية:

جاء في الشرح الكبير للدردير: ( ويجب عليه إخدام أهله بأن يكون الزوج ذا سعة وهي ذات قدر ليس شأنها الخدمة، أو هو ذا قدر تزري خدمة زوجته به، فإنها أهل للإخدام بهذا المعنى، فيجب عليه أن يأتي لها بخادم وإن لم تكن أهلاً للإخدام أو كانت أهلاً والزوج فقير، فعليها الخدمة الباطنة، ولو غنية ذات قدر من عجن وكنس وفرش وطبخ له لا لضيوفه فيما يظهر، واستقاء ما جرت به العادة وغسل ثيابه).

مذهب الشافعية:

جاء في (المهذب) في فقه الشافعية لأبي اسحق الشيرازي- رحمه الله- ( ولا يجب عليها خدمته في الخبز والطحن والطبخ والغسل وغيرها من الخدم لأن المعقود عليه من جهتها هو الاستمتاع، فلا يلزمها ما سواه).

مذهب الحنابلة:

قالوا: ( وليس على المرأة خدمة زوجها من العجن والخبز والطبخ وأشباهه ككنس الدار وملء الماء من البئر، نصّ عليه أحمد؛ لأن المعقود عليه من جهتها هو الاستمتاع بها، فلا يلزمها غيره كسقي دوابه وحصاد زرعه)، ولكنهم مع هذا قالوا: ( لكن الأولى لها فعل ما جرت العادة بقيامها به، لأنه العادة ولا تنتظم المعيشة من دونه ولا تصلح الحال إلا به).

ابلغتني مصادر مطلعة، ان وزارة الاعلام احالت جريدة الشاهد اليومية الى النيابة العامة بتهمة المساس بالذات الأميرية، وأضافت المصادر أن عدد اليوم الجمعة نشر في صفحته العشرون (تسالي) صورة لسمو الأمير مع سمو ولي العهد في مجلس الأمة وطلب من القراء معرفة الفوارق السبعة، فيما اعتبرته الاعلام مساسا بالذات الأميرية.

أثار كتاب مدير إدارة الرقابة الهاتفية ناصر الكندري إلى شركات الانترنت لحجب موقع الـ«يوتيوب» أزمة داخلية في وزارة المواصلات، وكشف قصوراً واضحاً فيها بكيفية التعامل مع مثل تلك الحالات وأوضحت عدم معرفة مَن بيده القرار، في وقت وجّه النائب محمد الصقر انتقاداً لقرار الوزارة في أسلوب المنع والحجر والقرارات المتسرعة، ورأى أن ذلك لا يتناسب مع ما وصلت اليه تكنولوجيا المعلومات والاتصالات.

وفي حين نشرت «الجريدة» أمس صورة من الكتاب الصادر من إدارة الرقابة الهاتفية بالوزارة، إلى شركات الانترنت، نفى وزير المواصلات عبدالرحمن الغنيم في تصريح خاص لـ«الجريدة» نية الوزارة حجب الموقع، «خصوصا أن القرار الصادر من الوزارة بحجب الموقع والموجه إلى شركات الانترنت، لم يكن عن طريق الوزير أو وكيل الوزارة، لأن مثل هذه الإجراءات تتطلب مخاطبة رسمية إلى الجهات المعنية».

وكشفت مصادر مطلعة أن إدارة الرقابة الهاتفية تؤكد أن القرار ساري المفعول ويجب على شركات الانترنت تطبيق ما جاء فيه، في حين تشير المصادر إلى أن الوزير الغنيم ووكيل الوزارة عبدالعزيز العصيمي متمسكان برأيهما بتجميد القرار.

من جانبه، انتقد النائب الصقر قرار وزارة المواصلات بحجب الموقع، مشيراً إلى أن «أسلوب الحجر والمنع والقرارات المتسرعة لا يتناسب مع ما وصلت إليه تكنولوجيا الاتصالات والمعلومات»، مشدداً على أن «التعرّض للدين الإسلامي والقرآن الكريم أمر مرفوض ويجب أن يتصدى له كل مسلم، ولكن عبر تدبّر الوسائل الأنجع والأسلم».

وقال الصقر إن مراسلة القائمين على موقع الـ«يوتيوب» عن هذه المادة وضررها على المعتقدات الإسلامية كافية ليقوموا بإزالتها، كما حدث سابقاً للعديد من المواد ذات الأبعاد العرقية والسياسية والعنصرية والدينية كما تنص شروط النشر على الموقع.

وأضاف الصقر أن عقلية الحجب والمنع التي تنتهجها الأجهزة الحكومية هي التي تجعلها تندفع دائما لقرارات المنع وتكبيل الحريات العامة وحرية تدفق المعلومات، موضحاً أن موقع الـ«يوتيوب» موقع عالمي تتداول من خلاله معلومات وثائقية ومصورة ويستخدمه مئات الملايين حول العالم.

After the concert we were so drained and tiered, so we kicked back and took the afternoon off from all the shopping we were doing, and decided to take it easy and be lazy. We ( my family and i ) were watching movies on TV and drinking tea and eating sandwiches basically relaxing. It was getting outside, and we rested enough, so we headed to Lester square hoping to catch a good movie. The taxi we took dropped us next to Trocadero a small shopping mall within walking distance from Lester square. so while We were walking we found a crowd of people standing in a place called Ripleys Museum ( belive it or not) so of course curious me wanted to check it out ( i can’t help it curiosity is in my blood Kuwaitya mako fayda :p) i never noticed it before. It was nice , it’s basically a musme filled with 5 floors of wired and unbelievable stuff from a traveler named Ripley. Ripley collected wired and interesting stuff during his travels, It was quit educational and funnnnnn, i think if your ever go to London you should visit and take a camera with you. And if you went there you would understand why i enjoyed it so much . of course i never forgot our readers and took a lot of pictures, with small labels explaining what exactly you’re looking at. Some don’t need labels they’re self explanatory ENJOYYYY

i know I’ve been obsessing about nails for a while, but i have to share this with you guys. My aunt came from the States after her summer vacation with all kinds of goodies and fanatig. I went to have fe6oor yesterday at her house with my family, and we started talking and gossiping about different stuff. The topic of nails somehow came up and she said that while she was shopping she stumbled on a NEW Sally Hansen product for nails which was perfect for the woman on the go. It’s a nail polish that looks like a pen, it’s very easy to use, you shake well then remove the cap, and click the top of the pen to dispense the color and apply. Unfortunately they don’t sell them here in Kuwait, and my aunt knows how i like new stuff so she gave me three of the many she got. Click on Sally Hansen web site at the bottom of the post.

KUWAIT: The Ministry of Communication has issued a memo to all internet service providers in Kuwait asking them to block YouTube access. The popular video website came under fire from the ministry due to content considered offensive to Muslims, a source within the industry told Kuwait Times. The Ministry pointed to content including a video of a man signing verses from the Holy Quran while playing the oud and another video showing caricatures of the Prophet Mohammad (PBUH).

A Fasttelco source confirmed receipt of the memo. “It’s supposed to be blocked right now. But due to technical preparations the blocking may take until tomorrow [Monday],” said the source. The site was still accessible yesterday evening. The Ministry of Communication regularly issues memos to ISPs asking them to block certain websites, including those containing pornographic photos or ones like Skype that can be used to make international phone calls over the Internet.

YouTube is widely used in Kuwait. A search of the word ‘Kuwait’ turned up 59,000 videos, including everything from videos of car crashes on Fahaheel Expressway and Jessica Simpson’s concert for US troops in Kuwait to protests in front of Abdullah Al-Salem hall in the run up to the 2006 parliamentary elections.

I’m not for blocking it. One should be able to choose what to watch. The YouTube itself has so many beneficial things that can help people get information and interact with each other,” says Abdelatif, a Muslim living in Kuwait. “Censorship equals ignorance as far as I’m concerned. Everything is there, it’s up to you to decide what to see or not.

YouTube has an option that allows users to report offensive content. It will then remove content deemed offensive.

The website has been banned or parts of its content blocked by several countries around the world. A Turkish court banned Youtube in March 2007 after Greek and Turkish users posted insulting videos on the website. Thailand banned the video sharing website a month later over content insulting the king. A Brazilian court ordered the website blocked after users posted a video of Brazilian supermodel Daniela Cicarelli having sex on a beach with banker boyfriend Renato Malzoni. The court decision was later reve
rsed and YouTube can now be accessed from Brazil.

Content offensive to Muslims and considered insulting to Islam however led Pakistan in early 2008 to ban YouTube. Both Iran and the United Arab Emirates block controversial content on the video sharing site. The UAE also censors content in photo sharing site Flickr. Blocking a website, though, has limited effect as most Internet users are savvy enough to use proxy services to access banned content.

Kuwait plans $130bn financial sector expansion

Kuwait is preparing a five-year plan worth $130.9 billion which aims to develop the financial sector and lure more foreign investment, state news agency KUNA said.

The OPEC producer wants to diversify its economy away from oil by becoming a regional financial centre and attracting tourists as nearby Dubai and Bahrain have done, according to the state’s 2009-2014 policy strategy plan obtained by Reuters in April.

The plan would cost a total of 35 billion dinars to fund projects and train administration staff, Moudhi Al-Humud, the minister of state for housing and development, told KUNA late on Thursday after a cabinet meeting.The draft law for the plan will be sent to parliament before it reconvenes in October, she added.

Under the plan, prepared by the country’s top planning council, Kuwait aims to boost its non-oil economy, which currently accounts for less than 10 percent of state revenues, by launching several big projects and improving the Gulf Arab state’s infrastructure.

It also seeks to ease land ownership rules and give the private sector more access to land, and control spending as inflation rises. More than 90 percent of land in Kuwait is owned by the government. (Reuters)
